TEMPORARY OUTDOOR DINING GUIDELINES
In response to the new social distancing requirements necessitated by the COVID-19 pandemic The Town of Dartmouth is allowing restaurants /cafes and other eating establishments to operate in outdoor settings. This is a temporary program which will be available for the duration of the outdoor summer dining season through November 1, 2020. The Town reserves the right to modify/expand this program at any time, as conditions may change.
An internal review group comprised of Frank Gracie, as appointee of the Select Board, the Town Administrator, the Licensing Aide, the District Fire Chiefs, the Building Commissioner and the Director of Public Health will review the plans submitted by the business owner with respect to location, accessibility and public safety and how best to coordinate these with the flow of pedestrian and vehicular traffic, parking and insurance requirements.
Alcoholic Beverages. Approval of a temporary outdoor dining area shall not be construed as an approval for the alteration or extension of premises where alcoholic beverages are served. The serving or consumption of alcohol outside of the premises of a duly licensed establishment to serve alcohol must be approved by the Select Board on a case-by-case basis.
SUBMISSION AND APPROVAL OF APPLICATIONS
1. Applications for temporary outdoor dining permits shall be submitted on a form provided by the Town and shall include a plan that complies with the Outdoor Seating Guidelines and with any applicable order of the Massachusetts Governor, Massachusetts Department of Public Health or other State agency, including any guidance for social distancing or for the operation of food services establishments.
2. Completed applications shall be submitted to the Town Administrator. The plans will be reviewed by the internal review group for compliance with guidelines and all safety requirements. Select Board Member Frank Gracie has been designated by the Select Board as the final approval authority. The Select Board’s designee may approve or deny an application or seek additional information from an applicant if he determines, in his discretion, that the application does not meet the Outdoor Seating Guidelines or comply with any of the Commonwealth Orders. Temporary outdoor seating permits may include conditions of approval such as daily cleaning and maintenance of the temporary outdoor seating area.
